These Terms and Conditions set out the basis on which Rubbish Removal Bow provides waste collection and rubbish removal services in the United Kingdom. By making a booking, using our services, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any rubbish removal or waste clearance service.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business, local household, or organisation requesting or receiving rubbish removal or waste collection services from us.

Services means any rubbish removal, waste collection, waste clearance, loading, transportation, recycling, disposal, or related services that we agree to provide.

Contract means the agreement between the Customer and Rubbish Removal Bow for the provision of Services, incorporating these Terms and Conditions.

Waste means any rubbish, refuse, junk, unwanted items, or other materials that the Customer asks us to remove, subject to applicable waste regulations.

We, us, and our means Rubbish Removal Bow, the service provider supplying the Services.

2. Scope of Services

We provide rubbish removal and waste collection services for domestic and commercial customers, including but not limited to general household waste, bulky items, garden waste, light construction waste, and office clearances, subject to applicable law and these Terms and Conditions.

Services are generally offered on-demand or by prior booking within our designated service area. Availability may vary depending on capacity, location, access, traffic conditions, and other operational factors. We reserve the right to decline any booking or request at our discretion.

3. Booking Process

3.1 Customers may request a booking by telephone, email, online form, or any other method we make available from time to time. All bookings are subject to our acceptance and confirmation.

3.2 At the time of booking, you must provide accurate details including your name, contact information, collection address, description and approximate volume or weight of waste, access restrictions, and any other information we reasonably request.

3.3 Any quotation provided prior to our arrival is based on the information supplied by you and is therefore an estimate only. We may revise the quotation once our operatives have inspected the waste on site and confirmed the actual volume, weight, access conditions, and type of materials to be collected.

3.4 A booking is only confirmed when we issue a confirmation by email, text message, or verbal confirmation, and we have agreed a collection date and time window. The Contract between you and us is formed at the point of confirmation.

3.5 You must ensure that someone aged 18 or over is present at the property during the agreed collection time to give access and, if required, to sign any paperwork or confirm final charges.

4. Access and Customer Responsibilities

4.1 You must provide safe, reasonable, and lawful access to the property, waste area, and any communal spaces required for our operatives to carry out the Services.

4.2 You are responsible for ensuring that the waste to be collected is clearly identified and separated where necessary. Any specific items that must not be taken should be clearly indicated in advance and on arrival.

4.3 If access to the property or to the waste is restricted, unsafe, or significantly different from the information provided at the time of booking, we may:

a. Charge waiting time or additional labour fees.

b. Revise the quotation to reflect additional work or time.

c. Cancel the Service and charge a call-out or cancellation fee as set out in these Terms and Conditions.

4.4 You must not request our operatives to break or breach any laws, regulations, building rules, or health and safety requirements. Our staff may refuse to carry out any task they deem unsafe or unlawful.

5. Pricing and Payment Terms

5.1 Prices for rubbish removal and waste collection are generally based on one or a combination of the following: volume, weight, loading time, type of waste, access conditions, and any additional services requested, such as dismantling or packing.

5.2 Unless otherwise agreed, our prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes. Any applicable taxes will be clearly stated in the quotation or invoice where required.

5.3 We reserve the right to change our prices at any time. Any price changes will not affect confirmed bookings where the Contract has already been formed, unless the scope of work or the nature of the waste is found to be different upon arrival, in which case a revised quotation may be issued.

5.4 Payment is due on completion of the Service, unless otherwise agreed in writing. We may request part or full payment in advance, particularly for larger collections or commercial jobs.

5.5 We accept payment by cash, approved card, bank transfer, or other methods we may introduce. You agree to pay all charges in full and without set-off or deduction.

5.6 If you fail to make payment when due, we reserve the right to charge interest on any overdue amount at the statutory rate allowed under UK law, and to recover all reasonable costs and expenses incurred in pursuing the debt.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by contacting us directly. Cancellations or changes must be made within our stated operating hours.

6.2 If you cancel at least 24 hours before the agreed collection time, no cancellation fee will normally apply, unless a special arrangement or non-refundable deposit has been agreed in advance.

6.3 If you cancel within 24 hours of the scheduled collection time, we reserve the right to charge a cancellation fee to cover administrative and operational costs, which may include any travel or time already incurred.

6.4 If our operatives attend the property at the agreed time and are unable to carry out the Services due to reasons beyond our control, such as lack of access, no adult present, or waste not being available, we may treat this as a late cancellation and apply a call-out or cancellation charge.

6.5 We may cancel or reschedule your booking if we are unable to provide the Services due to circumstances beyond our reasonable control, including but not limited to adverse weather, road closures, vehicle breakdowns, staff illness, or legal restrictions. In such cases, we will aim to notify you as soon as reasonably practicable and rearrange the collection.

7. Waste Types and Excluded Items

7.1 Our rubbish removal services are intended for general household waste, commercial waste, and non-hazardous materials. Certain items are restricted or may attract additional charges due to disposal regulations.

7.2 We do not ordinarily collect hazardous or specialist waste such as asbestos, clinical waste, medical sharps, pressurised containers, certain chemicals, large quantities of paint, gas bottles, or any materials classified as hazardous under applicable waste legislation, unless explicitly agreed in advance and handled in accordance with regulations.

7.3 If we discover hazardous, prohibited, or undisclosed materials among the waste, we may refuse to remove those items, revise the price, or terminate the Service. You may be charged for any wasted journey, additional labour, or costs incurred in handling such materials.

7.4 You are responsible for informing us in advance of any items that may require special handling, including electrical appliances, refrigerators, tyres, mattresses, or heavy building waste. Additional charges may apply to such items in line with disposal costs and regulatory requirements.

8. Waste Handling and Regulatory Compliance

8.1 We will handle, transport, recycle, and dispose of collected waste in accordance with applicable UK waste management laws and regulations, including any duty of care obligations that apply to us as a waste carrier.

8.2 By using our Services, you confirm that you have the right to dispose of the waste and that it does not originate from unlawful activities. You agree to indemnify us against any claims, costs, or penalties arising from your failure to have such rights or from providing false or misleading information.

8.3 We may issue a waste transfer note or other documentation where required by law or where requested by the Customer. You should retain any such documents for your records and legal compliance.

8.4 We aim to minimise landfill by recycling and recovering materials where reasonably possible. However, we do not guarantee that any specific proportion of your waste will be recycled or that particular items will be handled in a particular way, as this depends on the nature of the waste and the facilities available.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. However, we shall not be liable for any loss or damage that is not reasonably foreseeable or that arises from your failure to comply with these Terms and Conditions.

9.2 We are not liable for household or commercial items that you intend to keep but that are mistakenly presented as waste or are otherwise removed due to unclear instructions or lack of identification. You must clearly separate and label any items that are not to be taken.

9.3 While our operatives will take reasonable care when moving waste through your property, you are responsible for protecting floors, walls, door frames, and other surfaces where necessary. We shall not be liable for minor cosmetic damage or wear and tear arising from the normal performance of the Services.

9.4 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.

9.5 Except as stated above, our total liability to you for any loss or damage arising out of or in connection with the Contract, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.

10. Insurance

10.1 We maintain insurance cover appropriate to our business, including public liability insurance, subject to the terms, conditions, and exclusions of the relevant policies.

10.2 Our insurance does not cover items that you failed to identify as non-waste, nor does it cover losses caused by your negligence, misuse, or failure to follow our reasonable instructions.

11. Customer Conduct

11.1 You agree to treat our staff and operatives with respect and not to engage in abusive, threatening, or discriminatory behaviour. We reserve the right to withdraw services or terminate the Contract immediately if our staff are subjected to unacceptable conduct.

11.2 We reserve the right to refuse access or leave the site if our staff believe that their safety is at risk. In such circumstances, we may charge a reasonable fee for any time or costs already incurred.

12. Privacy and Data Protection

12.1 We process personal information in order to handle bookings, payments, and communications, and to comply with our legal obligations.

12.2 We will take reasonable steps to keep your personal information secure and to use it only for legitimate business purposes. Your information may be shared with third parties where necessary for the provision of Services, processing payments, or complying with law.

13. Termination

13.1 We may terminate the Contract immediately if you materially breach these Terms and Conditions, fail to pay any amount due, provide false information, or act in a way that puts our staff, property, or reputation at risk.

13.2 On termination, you must pay for all Services provided up to the date of termination and any other charges properly due under the Contract.

14. Changes to Terms and Conditions

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, industry practice, or our business operations.

14.2 The version of the Terms and Conditions in force at the time of your booking will apply to that Contract, unless we agree otherwise in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Contract or these Terms and Conditions.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or other competent authority, the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall be construed as a waiver of that right or remedy.

16.3 The Contract is between you and us. No other person shall have any rights to enforce any of its terms.

16.4 You may not assign or transfer your rights or obligations under the Contract without our prior written consent. We may assign or transfer our rights and obligations where reasonably necessary for the operation of our rubbish removal and waste collection services.
